DMCA Copyright Policy
Digital Millennium Copyright Act Notice and Takedown Procedures
1. Overview
CloudFran respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our platform that are reported to our Designated Copyright Agent.
2. Reporting Copyright Infringement
If you are a copyright owner, or authorized to act on behalf of one, and believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to our Designated Copyright Agent with the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, including the URL or other specific location on our platform
- Your contact information, including address, telephone number, and email address
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on their behalf

Response Time: We aim to respond within 48-72 business hours
3. Takedown Process
Upon receiving a valid DMCA notice, CloudFran will:
- Remove or disable access to the allegedly infringing material
- Notify the content provider, member, or user that the material has been removed
- Provide information about the counter-notification process
- Terminate accounts of repeat infringers in appropriate circumstances
4. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the material that was removed and its prior location
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your name, address, telephone number, and a statement consenting to jurisdiction of the federal court in your district
5. Repeat Infringer Policy
- First violation: Content removal and formal warning
- Second violation: Content removal and 30-day account suspension
- Third violation: Permanent account termination
6. Good Faith Requirements
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees.
7. Content Uploader Responsibilities
By uploading or linking content to CloudFran's platform, users certify that they:
- Own the copyright to the content, OR
- Have obtained express written permission from the copyright owner, OR
- The content is in the public domain or properly licensed for commercial use
Users agree to indemnify CloudFran against any claims arising from their content uploads.
